We are delighted to receive confirmation that our appeal against a local occupancy condition imposed on a barn conversion in the Yorkshire Dales National Park has been allowed.
The planning condition relates to a historical planning consent granted by Eden District Council in the late 1990's; however, the property is now located with the extended Yorkshire Dales National Park area.
PFK Planning submitted a planning application to the Yorkshire Dales National Park, which was refused by their Planning Committee. An appeal against this decision was made in July 2018, supported by our grounds of appeal which outlined the justification for the removal of the condition in these circumstances. The condition was not considered to be precise or enforceable.
On the 27th March 2019, we received the appeal decision which confirmed that the Planning Inspectorate upheld our appeal against the retention of the condition. The Inspector agreed that the condition was not sufficiently precise and also found no conflict with Policy RUR3 of the adopted Local Plan.
